Chapter 8: The prohibition of selling surplus water which is in the wilderness and is needed to take care of the pasture. The prohibition of not allowing others to use it. The prohibition of Stud fees
بَاب تَحْرِيمِ بَيْعِ فَضْلِ الْمَاءِ الَّذِي يَكُونُ بِالْفَلَاةِ وَيُحْتَاجُ إِلَيْهِ لِرَعْيِ الْكَلَأِ وَتَحْرِيمِ مَنْعِ بَذْلِهِ وَتَحْرِيمِ بَيْعِ ضِرَابِ الْفَحْلِ
Sahih Muslim 1565 b
Jabir b. 'Abdullah (Allah be pleased with him) reported that Allah's Messenger (ﷺ) forbade the hiring of a Camel to cover a she-Camel and from selling water and land to be tilled. So from all this the Messenger of Allah (ﷺ) forbade.
وَحَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، أَخْبَرَنَا رَوْحُ بْنُ عُبَادَةَ، حَدَّثَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي أَبُو الزُّبَيْرِ، أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ، يَقُولُ نَهَى رَسُولُ اللَّهِ صلى الله عليه وسلم عَنْ بَيْعِ ضِرَابِ الْجَمَلِ وَعَنْ بَيْعِ الْمَاءِ وَالأَرْضِ لِتُحْرَثَ . فَعَنْ ذَلِكَ نَهَى النَّبِيُّ صلى الله عليه وسلم .
